These terms apply whenever you use Wink Eat — to order food as a customer, or to sell it as a partner restaurant. Please read them before your first order; the short version is that restaurants are responsible for the food, we are responsible for the platform and your payment, and you can always reach a person if something goes wrong.

01About Wink Eat
Wink Eat (eat.winkget.com) is an online food ordering platform operated by Chandrabhan Kumar Yadav, Mishrabatarahan, Gopalganj, Bihar 841438 (“Wink Eat”, “we”, “us”). It lets you browse the menus of restaurants, cafés, cloud kitchens and food sellers listed with us (“partner restaurants”) and order from them for delivery, for takeaway, or at your table by scanning the restaurant's Wink Eat QR code.
Wink Eat is a marketplace. The food is prepared, packed and sold by the partner restaurant you order from; Wink Eat provides the technology that carries your order to the restaurant and the payment to us on its behalf. These terms explain what each of us is responsible for.
02Accepting these terms
By creating an account, placing an order, or listing a restaurant on Wink Eat you agree to these Terms & Conditions together with our Privacy Policy, Cancellation & Refund Policy and Shipping & Delivery Policy, which form part of them. If you do not agree, please do not use the platform.
You must be at least 18 years old, or use Wink Eat under the supervision of a parent or guardian who accepts these terms on your behalf.
03Your account
You sign in with your mobile number, which we verify with a one-time password. Please give a working number and a correct delivery address: the restaurant uses them to reach you, and an order that cannot be delivered because of a wrong address or an unreachable number is treated as delivered.
You are responsible for what happens under your account. If you think someone else has used it, tell us at winkgetmeal@gmail.com straight away. We may suspend an account used for fraud, abuse of offers, repeated refusal of cash-on-delivery orders, or behaviour that puts restaurant staff or delivery staff at risk.
04Placing an order
Menus, item descriptions, photographs, prices, preparation times and availability are set by each partner restaurant. We ask restaurants to keep them accurate, but a dish may occasionally be unavailable or look different from its photo. If an item you ordered cannot be supplied, the restaurant will tell you, and you will not be charged for it.
Your order is a request to the restaurant. It becomes a confirmed order when the restaurant accepts it, which you will see on the order page. A restaurant may decline an order — for example when it is closed, too busy, out of an ingredient, or your address is outside its delivery area — and any amount you paid is then refunded in full.
If you have a food allergy or a dietary requirement, please check the dish with the restaurant before ordering. The veg / non-veg marks and descriptions are provided by the restaurant, and Wink Eat cannot guarantee that a dish is free of any ingredient.
05Prices, charges and taxes
Prices are in Indian Rupees and are shown as set by the restaurant. Before you pay, your cart shows the full amount payable, including any delivery charge, packaging charge and applicable taxes. You will not be asked to pay anything that was not shown to you at checkout.
Restaurants are responsible for the GST and other taxes on the food they sell and for issuing a bill for it. Offers and discount codes come with their own conditions, apply only while they are live, and cannot be exchanged for cash.
06Payment
You can pay online — by UPI, debit or credit card, net banking or wallet — through our payment partner Razorpay, or in cash on delivery where the restaurant offers it. For table orders you may pay online or at the restaurant's counter.
Online payments are processed by Razorpay on its secure pages. Wink Eat does not see or store your full card number, CVV, UPI PIN or net-banking password. Your bank or card issuer may apply its own charges, which are outside our control.
If money leaves your account but the order is not confirmed, the amount is refunded automatically, usually within 5–7 working days — see the Cancellation & Refund Policy.
07Delivery, takeaway and table orders
Delivery areas, estimated times and charges are shown before you order, and are explained in the Shipping & Delivery Policy. Estimated times are estimates: traffic, weather and the restaurant's workload can move them. For takeaway, please collect your order at the time shown. For table orders, the order is linked to the table whose QR code you scanned and is served by the restaurant's staff.
08Cancellations and refunds
You can cancel an order free of charge until the restaurant accepts it. Once it is being prepared it generally cannot be cancelled, because the food cannot be resold. Missing, wrong, spilled or spoiled items are put right under our Cancellation & Refund Policy, which sets out how to report a problem and how long a refund takes.
09Partner restaurants
A restaurant that lists on Wink Eat agrees that it:
- holds a valid FSSAI licence or registration, and any other licence its business needs, and keeps the details it gives us up to date;
- prepares food hygienically, packs it safely and supplies what it lists at the price it lists;
- keeps its menu, prices, opening hours and item availability current;
- is responsible for the quality, safety and taxes of the food it sells, and for its own delivery staff;
- uses customer details only to fulfil the order they were shared for.
Payments collected online for a restaurant's orders are settled to the restaurant after deducting any commission or fee agreed with it. We may remove a listing that repeatedly breaches these terms or receives serious, verified complaints.
10Using Wink Eat fairly
You agree not to:
- place fake orders, or orders you do not intend to accept or pay for;
- misuse offers, referral codes or refunds;
- post reviews that are false, abusive, or written for something you did not order;
- copy, scrape or resell the platform's content, or try to break into or overload it;
- harass or threaten restaurant staff, delivery staff or our team.
Reviews and ratings must reflect your own experience. We may remove content that breaks these rules or the law.
11Content and trademarks
The Wink Eat name, logo, software and design belong to the operator of Wink Eat. Restaurant names, logos, menus and photographs belong to the restaurants that provide them. Nothing on the platform gives you a licence to use any of these except to order through Wink Eat.
12Our responsibility
We work to keep Wink Eat available and accurate, but the platform is provided as it is and may occasionally be unavailable for maintenance or for reasons beyond our control.
The restaurant is responsible for the food it prepares. To the extent the law allows, Wink Eat's total liability for any claim about an order is limited to the amount you paid for that order. Nothing in these terms limits any right you have under the Consumer Protection Act, 2019 or other law that cannot be excluded.
13Changes, suspension and governing law
We may update these terms as the service changes. The date at the top of this page shows the latest version, and continuing to use Wink Eat after a change means you accept it.
These terms are governed by the laws of India. Any dispute will be subject to the jurisdiction of the courts at Gopalganj, Bihar.
14Grievances and contact
In line with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Rules, 2021, our Grievance Officer is Chandrabhan Kumar Yadav. We acknowledge a complaint within 48 hours and aim to resolve it within 15 days; it will be closed no later than one month from the day we receive it.
